Welcome to The Mat Kitchen. These Terms of Service ("Terms") apply to your use of www.thematkitchen.com.au (the "site") and to every order you place with us. By using the site or placing an order, you agree to these Terms, together with our Privacy Policy and Refund Policy. Please read them — they're written to be understood, not to catch you out.

1 · About us

The Mat Kitchen is operated by Eleanor White trading as The Mat Kitchen (ABN 30 350 893 623), based in Carlton North, Victoria. We prepare and deliver fresh, nourishing meals designed for the postpartum journey, across our Melbourne delivery area.

2 · Our meals

  • Our meals are fresh, perishable food, cooked in small batches and delivered chilled. Each meal comes with storage guidance and, where relevant, reheating instructions — please follow them, and refrigerate your delivery promptly.
  • Product photos and descriptions on the site are as accurate as we can make them, but ours is real, handmade food: appearance, garnish, and exact ingredients may vary slightly with the seasons and market availability. If we need to make a meaningful substitution to your order, we'll let you know.
  • Menu items, prices, and availability may change at any time. All prices are in Australian dollars and include GST.

3 · Allergies and dietary requirements

Please read this section carefully.

  • Our meals are prepared in a kitchen that handles common allergens, including (but not limited to) gluten, dairy, eggs, nuts, sesame, soy, fish, and shellfish. While we take great care, we cannot guarantee that any meal is completely free of any allergen.
  • If you have a food allergy or intolerance, please tell us before ordering (info@thematkitchen.com.au) so we can advise whether we can safely cater to you. It is your responsibility to review the ingredient information provided and to make your own decision about whether a meal is suitable for you.
  • Our meals are food, made with love — they are not medical or therapeutic products, and nothing on our site is medical, dietetic, or health advice. Please consult your doctor, midwife, or an accredited practising dietitian about your individual nutritional needs, particularly while pregnant or breastfeeding.

4 · Ordering and payment

  • When you place an order, you're making an offer to purchase. Your order is accepted when we send you an order confirmation. We may decline or cancel an order (with a full refund) if an item is unavailable, if there's a pricing or listing error, if your address is outside our delivery area, or if we reasonably suspect fraud.
  • Payment is taken at checkout through our secure payment providers via Shopify. We don't store your card details.
  • You must be at least 18 years old to place an order, and you're responsible for keeping your account details accurate and your login secure.

5 · Delivery

  • We deliver to selected Melbourne postcodes — the postcode checker on our site confirms whether we deliver to you. Delivery days and windows are shown at checkout.
  • Please make sure your delivery address, phone number, and any access notes are complete and correct. We rely on them.
  • Your meals arrive chilled in insulated packaging. If no one is available at delivery, we'll leave your order at your front door or nominated safe place. From the moment your order is delivered to the address you provided, responsibility for it passes to you — please refrigerate it promptly. See our Refund Policy for what happens if a delivery goes wrong.
  • Delivery times are estimates. We'll always let you know if we're running significantly late, and the Refund Policy covers significant delays or failed deliveries that are our fault.

6 · Changes, cancellations, and refunds

Because everything is made fresh to order, changes and cancellations must be made at least 48 hours before your scheduled delivery date. Our Refund Policy forms part of these Terms and sets out the details, including your remedies if something is wrong with your order.

7 · Gift cards

Gift cards are delivered by email, are valid for three years from the date of issue, can be used across multiple orders, and are redeemable only through the site. They can't be exchanged for cash, and any unused balance remains on the card until it's used or expires. Please treat your gift card code like cash — we can't replace value lost through unauthorised use of a code you've shared.

8 · Your rights under the Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

9 · Liability

To the extent permitted by law (and subject always to section 8):

  • We are not liable for loss or spoilage of meals after they have been delivered as instructed to the address you provided, including where they are left unrefrigerated after delivery.
  • We are not liable for issues arising from inaccurate information you provide — including delivery details or allergy and dietary information you did not disclose to us.
  • We are not liable for delays or failures caused by events outside our reasonable control (such as extreme weather, road closures, or supplier failures), though we will always work with you to reschedule, credit, or refund affected orders.
  • Our total liability in connection with any order is otherwise limited to resupplying the meals or refunding the amount you paid for the order.

10 · Using our site

You agree to use the site lawfully and not to interfere with its operation, attempt to gain unauthorised access, scrape or harvest data, or use it to transmit anything malicious or unlawful. We may suspend or terminate access to the site or refuse service where these Terms are breached.

11 · Intellectual property

Everything on the site — our name, logo, branding, recipes, photography, and written content — belongs to The Mat Kitchen or is used with permission. You're welcome to share links to our site, but please don't reproduce or use our content commercially without written permission.

12 · Privacy

Our Privacy Policy explains how we collect, use, and protect your personal information, and forms part of these Terms.

13 · General

  • If any part of these Terms is found to be invalid or unenforceable, the rest remains in effect.
  • If we don't enforce a right under these Terms on one occasion, that isn't a waiver of it.
  • We may update these Terms from time to time; the version published on this page at the time you place an order is the one that applies to that order.
  • These Terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria.
